La comunidad internacional, concretamente las Naciones Unidas, han necesitado m\u00e1s de 20 a\u00f1os para convencer a los pa\u00edses de la necesidad de replantear el sistema y apostar por una sociedad ZEO -cero emisiones-.<\/p>\n<p>Los intereses y los lobbies privados vinculados a la econom\u00eda f\u00f3sil han sido los principales causantes de que <strong>este proceso de toma de conciencia por parte de los pa\u00edses y de activaci\u00f3n de nuevas medidas para reducir emisiones haya sido tan lento e incluso<\/strong>, en ocasiones, tedioso.<\/p>\n<p>En paralelo, los fen\u00f3menos clim\u00e1ticos extremos y los cambios en el clima han sido los principales motores de la expansi\u00f3n de la conciencia clim\u00e1tica. Los \u00faltimos informes y estudios demuestran que el calentamiento global de la Tierra ha provocado que los huracanes, terremotos, ciclones y olas de calor, sean cada vez m\u00e1s extremos y sucedan con mayor frecuencia.<\/p>\n<p>La sociedad cada vez es m\u00e1s consciente de esta correlaci\u00f3n y reclama a los pol\u00edticos m\u00e1s implicaci\u00f3n en la lucha contra el cambio clim\u00e1tico, y m\u00e1s medidas y acciones concretas para ponerle fin.<\/p>\n<p>En paralelo, esta presi\u00f3n social e internacional por poner soluci\u00f3n a esta cuesti\u00f3n ha dado pie a unos Planes Nacionales de Energ\u00eda y Clima (PNIEC) cada vez m\u00e1s ambiciosos.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.26.3&#8243; En el camino hacia una sociedad ZEO y sostenible a\u00fan existe una asignatura pendiente: <strong>introducir los delitos contra el medio ambiente o ecocidios en el c\u00f3digo penal internacional.<\/strong><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.26.3&#8243; En teor\u00eda, fruto del desconocimiento sobre el impacto negativo y a largo plazo que pod\u00edan tener estas acciones en el Planeta y en la supervivencia de las especies.<\/p>\n<p>Sin embargo, es dif\u00edcil considerar como delitos acciones que tuvieron lugar hace m\u00e1s de un siglo y cuya responsabilidad recaer\u00eda en la humanidad en general y su proceso evolutivo.<\/p>\n<p>[\/et_pb_text][et_pb_image _builder_version=\u00bb3.26.3&#8243; Tambi\u00e9n la obligaci\u00f3n de castigar a aquellas personas y organismos privados o p\u00fablicos que amenazaran con destruirlo o que <strong>provocaran da\u00f1os severos al mismo.<\/strong><\/p>\n<p>Desde ese momento, empez\u00f3 todo un movimiento por parte de gobiernos, empresas y comunidades para reformar el Estatuto de Roma, el\u00a0instrumento constitutivo de la\u00a0Corte Penal Internacional de las Naciones Unidas aprobado el 17 de julio de 1988, e incluir el ecocidio como un delito penal y universal.<\/p>\n<p>Precisamente por ello, el objetivo de estos organismos ZEO <strong>siempre ha sido convertir el ecocidio en el quinto\u00a0crimen contra la paz<\/strong> del Estatuto de Roma de la Corte Penal Internacional (CPI).<\/p>\n<p>[\/et_pb_text][et_pb_image _builder_version=\u00bb3.26.3&#8243; Pero a d\u00eda de hoy, a\u00fan no se ha establecido como un crimen en el derecho internacional penal.<\/p>\n<p>Sin embargo, en 2021 el ecocidio fue reconocido y dotado de contenido jur\u00eddico propio. Los encargados de otorgar a ese t\u00e9rmino una definici\u00f3n jur\u00eddica fueron un panel de 12 juristas impulsado desde la sociedad civil.<\/p>\n<p>Los defensores de convertir el ecocidio en un delito ecol\u00f3gico y un crimen internacional aseguran que <strong>es necesario hacerlo, para as\u00ed garantizar el cumplimiento de los derechos humanos y proteger el medio ambiente<\/strong>. La oposici\u00f3n a esta reforma en la Ley Internacional argumenta que tipificar el da\u00f1o ecol\u00f3gico o medioambiental como un ecocidio convertir\u00eda autom\u00e1ticamente al conjunto de la raza humana en \u201ccriminales\u201d. El primero de ellos tuvo lugar durante la <strong>Guerra de Vietnam<\/strong>.<\/p>\n<p>Este suceso fue el pistoletazo de salida para la toma de conciencia sobre el grave impacto que pod\u00eda llegar a generar el hombre en la naturaleza y la necesidad de establecer mecanismos legales para evitar que esto suceda.<\/p>\n<p>Durante este conflicto b\u00e9lico, Estados Unidos utiliz\u00f3 defoliantes, es decir, productos qu\u00edmicos liberados a trav\u00e9s del aire, que causaron da\u00f1os irreversibles en los bosques tropicales de Vietnam y contaminaron sus r\u00edos y lagos.<\/p>\n<p>Como parte de la Operaci\u00f3n Ranch Hand se <strong>vertieron miles de litros de agente naranja para defoliar\u00a0los \u00e1rboles<\/strong> donde pudiese esconder la guerrilla del Vietcong, y destruir las cosechas con las que pudiese alimentarse.<\/p>\n<p>Esta fumigaci\u00f3n ocasion\u00f3 da\u00f1os irreparables a flora y fauna del pa\u00eds, e hizo que las zonas afectadas tardasen siglos en ser f\u00e9rtiles nuevamente. Esto permitir\u00eda disuadir a aquellos que est\u00e1n pensando en destruir o explotar el Planeta para enriquecerse, y detendr\u00eda a aquellos organismos que los cometen y que est\u00e1n
