Alba Iranzo es licenciada en Derecho y Periodismo<\/strong> por la Universidad Carlos III de Madrid, obtuvo un M\u00e1ster en Derecho Ambiental y Desarrollo Sostenible por la Universidad de Kingston en Londres. \u00bfC\u00f3mo puede la Ley ayudar a combatir el cambio clim\u00e1tico?<\/b><\/h3>\n<\/blockquote>\n

La ley es un instrumento clave en la toma de medidas para la lucha contra el cambio clim\u00e1tico, ya que proporciona un <\/span>marco estable dentro de nuestro Estado de Derecho que obliga a diferentes actores a cumplir con las medidas m\u00e1s efectivas para lograr los objetivos marcados. <\/b>Para ello, en nuestro \u00e1mbito se debe trabajar: 1) para garantizar que la normativa sea lo m\u00e1s ambiciosa posible y tenga en cuenta las mejores pr\u00e1cticas y las opiniones de expertos independientes, 2) y para vigilar que dicha normativa se cumpla de manera efectiva a trav\u00e9s de los instrumentos que proporciona la propia ley y el poder judicial.<\/span><\/p>\n

Para hacer frente al enorme reto que supone el cambio clim\u00e1tico, necesitamos una acci\u00f3n colectiva de la sociedad que requiere cambios de conducta, mayor innovaci\u00f3n tecnol\u00f3gica y una nueva gobernanza, entre otros. El Acuerdo de Par\u00eds es el inicio de esta nueva gobernanza, pero requiere que sea aplicado en el plano nacional para que sea efectivo.\u00a0<\/span><\/p>\n

La Agenda 2030 de Naciones Unidas <\/b>tambi\u00e9n es una iniciativa importante a nivel internacional para lograr sociedades m\u00e1s justas, equitativas y alcanzar ese desarrollo sostenible que necesitamos. Dentro de la Agenda 2030 se establecen los Objetivos de Desarrollo Sostenible, que muchos tienen un marcado car\u00e1cter ambiental. Una de las l\u00edneas de trabajo importantes en esta direcci\u00f3n ser\u00eda eliminar las barreras\/impedimentos que pueden existir en ciertas leyes y normas para lograr dichos objetivos. Por ejemplo, <\/span>el ODS 3 relativo a la salud contiene una meta que consiste en reducir sustancialmente el n\u00famero de muertes y enfermedades producidas por la contaminaci\u00f3n del aire, del agua y del suelo para 2030<\/strong>. Desde el IIDMA hemos trabajado en esta l\u00ednea, especialmente en temas de calidad del aire como Madrid Central o, especialmente, en la contaminaci\u00f3n e impactos en la salud producidos por las emisiones de la quema del carb\u00f3n para la producci\u00f3n de electricidad. Hemos publicado dos informes relativos a los impactos a la salud derivados de las centrales t\u00e9rmicas de carb\u00f3n en los a\u00f1os 2014 y 2016 que se pueden consultar en nuestra web.<\/span><\/p>\n

Ahora mismo, \u00bfEspa\u00f1a cuenta con un marco legal positivo para la lucha contra el cambio clim\u00e1tico?<\/b><\/h4>\n<\/blockquote>\n

Espa\u00f1a est\u00e1 en el camino y ha mejorado respecto al pasado, aunque debemos acelerar de manera urgente la toma de medidas. Actualmente existe un <\/span>borrador de Ley de Cambio Clim\u00e1tico y Transici\u00f3n Energ\u00e9tica (LCCT)<\/b> que debe determinar en gran medida el camino a seguir por nuestro pa\u00eds en los pr\u00f3ximos a\u00f1os. La aprobaci\u00f3n y entrada en vigor de esta Ley es una de las prioridades normativas en Espa\u00f1a en este momento.<\/span>\u00a0<\/span><\/p>\n

\n

\u00bf<\/span>Qu\u00e9 nuevas leyes, modificaciones o Reales decretos dir\u00edas que representan est\u00e1 \u201cpositividad\u201d?<\/b><\/h4>\n<\/blockquote>\n

Los instrumentos jur\u00eddicos m\u00e1s importantes que est\u00e1n ahora mismo sobre la mesa y que es necesario adoptar cuanto antes son los que integran el <\/span>Marco Estrat\u00e9gico de Cambio clim\u00e1tico y Transici\u00f3n Justa<\/b>: borrador de Ley de Cambio Clim\u00e1tico y Transici\u00f3n Energ\u00e9tica, el borrador del PNIEC 2021-2030 y la Estrategia de Transici\u00f3n Justa. Es urgente aprobar la LCCTE cuanto antes, llevamos varios a\u00f1os con diferentes proyectos sobre la mesa y, debido a la inestabilidad pol\u00edtica de nuestro pa\u00eds, seguimos sin contar con legislaci\u00f3n en esta materia.<\/span><\/p>\n

\u00a0<\/span>Como comentaba antes, lo m\u00e1s urgente es la aprobaci\u00f3n de estas propuestas que ya est\u00e1n sobre la mesa: una versi\u00f3n final del PNIEC, que debe ser presentada ante la Comisi\u00f3n Europea antes del 31 de diciembre de 2019 -un primer borrador de este plan ya fue enviado a la CE el pasado febrero y contest\u00f3 en junio pidiendo m\u00e1s ambici\u00f3n-, y la LCCTE, que debe ser aprobada cuanto antes para poder tener un marco estatal para la lucha contra el cambio clim\u00e1tico.<\/strong> Adem\u00e1s, algunas CCAA ya han aprobado o tienen en proceso Leyes de cambio clim\u00e1tico regionales (Baleares, Andaluc\u00eda, Catalu\u00f1a, Pa\u00eds Vasco).<\/span><\/p>\n

\u00bfSi lo comparamos con el resto de los pa\u00edses firmantes de la Uni\u00f3n Europea, Espa\u00f1a es un pa\u00eds m\u00e1s avanzado en este sentido?\u00a0<\/b><\/h4>\n<\/blockquote>\n

El borrador de <\/span>PNIEC espa\u00f1ol<\/b> ha sido valorado como uno de los m\u00e1s adecuados a los objetivos de la UE y es positivo, pero debe contener objetivos de descarbonizaci\u00f3n mucho m\u00e1s ambiciosos. El texto actual ahora mismo est\u00e1 lejos de cumplir <\/span>con el objetivo del Acuerdo de Par\u00eds de limitar el aumento de la temperatura por debajo del 1,5\u00baC<\/b>. Adem\u00e1s, el plan debe ser m\u00e1s claro en lo relativo al carb\u00f3n, ya que no se incluye una fecha para el cierre de las centrales t\u00e9rmicas, sino un intervalo de la posible capacidad que permanecer\u00e1 instalada en 2030.\u00a0<\/span><\/p>\n

Comprometerse a poner fin al carb\u00f3n no supone un peligro para la seguridad de suministro en nuestro pa\u00eds, y es una de las prioridades ahora mismo en la que desde IIDMA venimos haciendo hincapi\u00e9 desde hace a\u00f1os. Es perfectamente factible cerrar todas las centrales en el a\u00f1o 2025 a m\u00e1s tardar,<\/strong> y esta fecha debe ser incluida en el PNIEC y\/o la LCCTE.<\/span><\/p>\n

El enfoque del Miteco desde que se ha creado como tal con Teresa Ribera al frente, supone una mejora frente a la etapa anterior. El Miteco entiende que la lucha contra el cambio clim\u00e1tico es una prioridad, y est\u00e1 siguiendo pasos adecuados, pero debe ser todav\u00eda m\u00e1s ambicioso y acelerar muchas de las medidas que est\u00e1n sobre la mesa.<\/span><\/p>\n

\u00a0<\/span>\u00bfQu\u00e9 logros significativos ha conseguido este departamento?<\/b><\/h4>\n<\/blockquote>\n

\u00a0<\/span>El Miteco como tal fue creado en la \u00faltima legislatura, anteriormente hemos tenido Ministerios con competencias de medio ambiente y\/o energ\u00eda, muchas veces por separado, pero e<\/span>s la primera vez que hay un Ministerio dedicado a la transici\u00f3n energ\u00e9tica y lucha contra el cambio clim\u00e1tico como objetivo prioritario.<\/b>\u00a0<\/span><\/p>\n

El logro m\u00e1s significativo de este nuevo ministerio ha sido la voluntad de desbloquear situaciones que se estaban alargando demasiado, como el cierre de minas o centrales de carb\u00f3n, o tratar de sacar adelante borradores de la Ley de Cambio Clim\u00e1tico<\/strong>, aunque todav\u00eda debe haber m\u00e1s ambici\u00f3n y la Ley de Cambio Clim\u00e1tico debe aprobarse lo antes posible.<\/span><\/p>\n

\u00bfC\u00f3mo mejor\u00e1is el terreno legal para la transici\u00f3n y la descarbonizaci\u00f3n de la econom\u00eda, desde el Instituto Internacional de Derecho y Medioambiente?<\/b><\/h4>\n<\/blockquote>\n

\u00a0<\/span>Desde el IIDMA nos dedicamos a investigar y a realizar an\u00e1lisis e informes sobre diferentes aspectos medioambientales (recursos h\u00eddricos, biodiversidad, transici\u00f3n energ\u00e9tica o cambio clim\u00e1tico). Adem\u00e1s, participamos en reuniones y cumbres de organismos internacionales en calidad de ONG. <\/span>Hemos tomado parte en diversas negociaciones y reuniones de las Naciones Unidas, la \u00faltima en el grupo de expertos para un Pacto Mundial para el Medio Ambiente este mismo a\u00f1o, al que ha asistido la directora del IIDMA Ana Barreira.\u00a0<\/strong><\/span><\/p>\n

Asimismo, iIDMA ha impartido clases de derecho y pol\u00edtica ambiental en diversos m\u00e1steres universitarios. \u00bfDir\u00edas que sois una especie de abogados del planeta?<\/b><\/h4>\n<\/blockquote>\n

\u00a0<\/span>Somos una organizaci\u00f3n o centro de derecho ambiental sin \u00e1nimo de lucro con el objetivo de contribuir a la protecci\u00f3n del medioambiente y la consecuci\u00f3n de un desarrollo sostenible a trav\u00e9s del estudio, desarrollo, aplicaci\u00f3n y ejecuci\u00f3n del Derecho desde una perspectiva internacional y multidisciplinar.<\/span><\/p>\n

Desde 1998, IIDMA es una organizaci\u00f3n acreditada ante la Asamblea de las Naciones Unidas para el Medio Ambiente, lo que nos ha permitido acudir a estas reuniones en Nairobi donde se abordan temas tan actuales como la contaminaci\u00f3n por pl\u00e1stico o la geoingenier\u00eda marina.<\/strong> Adem\u00e1s, en 2001 IIDMA fue declarada una asociaci\u00f3n de utilidad p\u00fablica.<\/span><\/p>\n

La actual directora, Ana Barreira, fund\u00f3 IIDMA en el a\u00f1o 1996, una \u00e9poca en la que en Espa\u00f1a apenas hab\u00eda conciencia alrededor de la problem\u00e1tica medioambiental ni se trabajaba apenas en su defensa desde la abogac\u00eda.<\/span><\/p>\n

\u00bfQu\u00e9 medidas legales son prioritarias para vosotros en la lucha contra el cambio clim\u00e1tico?<\/b><\/h4>\n<\/blockquote>\n

\u00a0<\/span>Las prioridades en este campo son la aprobaci\u00f3n de los instrumentos del Marco Estrat\u00e9gico de Energ\u00eda y Clima<\/strong> con los objetivos m\u00e1s ambiciosos posibles, establecer 2025 como fecha de fin del carb\u00f3n en Espa\u00f1a, y acelerar la transici\u00f3n energ\u00e9tica sustituyendo en el mix energ\u00e9tico espa\u00f1ol -los combustibles f\u00f3siles (carb\u00f3n, gas etc)-, por energ\u00edas renovables de forma ordenada y progresiva.<\/span>\u00a0<\/span><\/p>\n

Tambi\u00e9n consideramos muy importante que se integre a la sociedad civil en la toma de decisiones de este tipo mediante procesos de participaci\u00f3n p\u00fablica y consulta donde, adem\u00e1s, se asegure el cumplimiento efectivo de la normativa y su aplicaci\u00f3n. <\/span>En materia de gobernanza clim\u00e1tica, creemos que es muy importante que la LCCTE espa\u00f1ola prevea la creaci\u00f3n de un Comit\u00e9 de Cambio Clim\u00e1tico y Transici\u00f3n Energ\u00e9tica<\/strong><\/span> independiente.\u00a0<\/strong><\/p>\n

Desde IIDMA participamos activamente en los procesos de participaci\u00f3n p\u00fablica que tramita el MITECO enviando nuestras observaciones como especialistas a los diferentes proyectos de textos legales en materia de clima y energ\u00eda. Tambi\u00e9n elaboramos informes y an\u00e1lisis en profundidad y tratamos de aplicar el m\u00e1ximo rigor en todos los informes que elaboramos, teniendo en cuenta las mejores pr\u00e1cticas disponibles y los textos y medidas m\u00e1s ambiciosos propuestos dentro del derecho internacional y por los expertos en la materia.\u00a0<\/span><\/p>\n

Nuestro objetivo es que la normativa espa\u00f1ola sea realmente ambiciosa en materia de medio ambiente para poder tener una protecci\u00f3n efectiva del mismo.<\/strong> Asimismo, es muy importante que el marco legal prevea herramientas para garantizar un cumplimiento efectivo de las obligaciones que contempla. Pues son muchas las ocasiones en que como organizaci\u00f3n, hemos tenido que recurrir a los tribunales para reclamar el cumplimiento de obligaciones que ya contempla nuestro ordenamiento jur\u00eddico.<\/span><\/p>\n

\u00bfExisten instituciones similares a la vuestra en otros pa\u00edses? \u00bfY en Espa\u00f1a?<\/b><\/h4>\n<\/blockquote>\n

S\u00ed, la m\u00e1s similar y cercana a nosotros ser\u00eda ClientEarth<\/strong>, una organizaci\u00f3n de derecho ambiental europea con sede en diferentes pa\u00edses como Reino Unido, Polonia o B\u00e9lgica.<\/span><\/p>\n

En este momento somos la \u00fanica organizaci\u00f3n espa\u00f1ola que aborda desde la perspectiva jur\u00eddica la problem\u00e1tica del medioambiente de forma especializada.<\/span> Nuestro objetivo a corto y medio plazo es crecer en n\u00famero de proyectos y ampliar las \u00e1reas en las que trabajamos. No obstante, siempre es dif\u00edcil encontrar financiaci\u00f3n para proyectos en el \u00e1rea medioambiental,<\/strong> aunque en los \u00faltimos a\u00f1os ha crecido la preocupaci\u00f3n e inter\u00e9s debido a los retos a los que nos enfrentamos. Por eso creemos que nuestro trabajo es fundamental, y puede interesar cada vez m\u00e1s por la importancia crucial que tiene el derecho, para la protecci\u00f3n ambiental y asegurar el futuro de nuestro planeta.<\/strong><\/span><\/p>\n

\u00a0<\/span>\u00bfCont\u00e1is con ayuda estatal para la financiaci\u00f3n de esta entidad?<\/b><\/h4>\n<\/blockquote>\n

\u00a0<\/span>Ahora mismo no contamos con ayudas estatales, aunque siempre buscamos financiaci\u00f3n para nuevos proyectos. En nuestros inicios se hizo mucho <\/span>fundraising<\/span><\/i> fuera de Espa\u00f1a. Hoy en d\u00eda un gran porcentaje de nuestra financiaci\u00f3n contin\u00faa viniendo de fuera de Espa\u00f1a. Es dif\u00edcil entender<\/strong>, con la situaci\u00f3n actual, c\u00f3mo es posible que esto siga sucediendo y no haya m\u00e1s fondos en Espa\u00f1a para sostener este tipo de trabajo de defensa de la legalidad ambiental.<\/strong><\/span><\/p>\n

Al final, el balance de nuestro trabajo es positivo pues a lo largo de estos a\u00f1os hemos abordado muchas tem\u00e1ticas en temas muy diversos, pero siempre relacionados con el medioambiente, como recursos h\u00eddricos, biodiversidad y medio marino, cambio clim\u00e1tico, transici\u00f3n energ\u00e9tica, contaminaci\u00f3n y calidad del aire, riesgos clim\u00e1ticos en el sector financiero y bancario, por mencionar algunos.<\/span><\/p>\n

\u00bfCu\u00e1les son las batallas m\u00e1s importantes que ha ganado iIDMA?<\/b><\/h4>\n<\/blockquote>\n

Hemos tenido importantes victorias en los tribunales, como el que llevamos para <\/span>Oceana<\/b> cuando no se la facilit\u00f3 la informaci\u00f3n del Informe del Instituto Espa\u00f1ol de Oceanograf\u00eda sobre el contenido de metales pesados en el pescado. Como consecuencia de la sentencia de la Audiencia Nacional, la Agencia de Seguridad Alimentaria modific\u00f3 las recomendaciones de ingesta semanal de at\u00fan, pez espada y marrajo en mujeres embarazadas y menores de tres a\u00f1os.\u00a0<\/strong><\/span><\/p>\n

Tambi\u00e9n hemos tenido una reciente victoria en los tribunales a ra\u00edz de un procedimiento que iniciamos contra el Plan Nacional Transitorio de Grandes Instalaciones de Combusti\u00f3n en el que, aunque inicialmente se nos conden\u00f3 al pago de las costas por haberse desestimado nuestra demanda, el TS reconoci\u00f3 que las ONG ambientales con justicia gratuita reconocida por Ley no tienen que pagar las <\/span>costas del procedimiento<\/b> judicial cuando pierden un caso, por lo que quedamos exentos de pagar los 11.260\u20ac.\u00a0<\/strong><\/span><\/p>\n

Esta decisi\u00f3n <\/span>sit\u00faa a Espa\u00f1a entre uno de los pa\u00edses m\u00e1s avanzados en materia de acceso a la justicia ambiental<\/b>, comparado con las barreras econ\u00f3micas a las que tienen que hacer frente otras organizaciones para acudir a los tribunales en otros Estados miembro.<\/span><\/p>\n

En 2018 elaborasteis un informe en el que se exig\u00eda la necesaria participaci\u00f3n ciudadana en la elaboraci\u00f3n del PNIEC \u00bfHab\u00e9is conseguido alg\u00fan avance en este sentido?<\/b><\/h4>\n<\/blockquote>\n

\u00a0<\/span>Si, desde el IIDMA trabajamos firmemente para que se garantice el cumplimiento del derecho de participaci\u00f3n p\u00fablica en asuntos ambientales que reconoce el 2\u00ba pilar del <\/span>Convenio de Aarhus<\/b> (Convenio sobre acceso a la informaci\u00f3n, la participaci\u00f3n del p\u00fablico en la toma de decisiones y el acceso a la justicia en materia de medio ambiente), ratificado por Espa\u00f1a en 2005 y, que por tanto, forma parte de nuestro ordenamiento jur\u00eddico y se debe cumplir.<\/span><\/p>\n

\u00a0<\/span>El informe que mencionas lo elaboramos en diciembre de 2018 con la finalidad de <\/span>hacer hincapi\u00e9 en la importancia de que el Gobierno espa\u00f1ol garantizara procesos de participaci\u00f3n p\u00fablica efectivos y transparentes durante el proceso de elaboraci\u00f3n del PNIEC 2021-2030<\/b>. Adem\u00e1s de analizar el contenido, el Reglamento de Gobernanza de la UE que regula la adopci\u00f3n de estos PNIECs, y exige que el borrador inicial del plan se someta a participaci\u00f3n del p\u00fablico, analizamos la exigencia de someter este plan a un procedimiento de EAE como exige nuestra Ley 21\/2013 de evaluaci\u00f3n ambiental. Consideramos que <\/span>la publicaci\u00f3n y difusi\u00f3n de dicho informe ha contribuido a dar visibilidad sobre esta materia y sobre todo abrir un debate<\/b>, dando a conocer al p\u00fablico y los distintos agentes implicados, el derecho que tienen a participar en el proceso de toma de decisiones entorno a este plan.<\/span><\/p>\n

\u00a0<\/span>De hecho, el pasado 11 de julio finaliz\u00f3 el plazo de consultas p\u00fablicas del procedimiento de EAE del PNIEC,<\/strong> en las que IIDMA ha participado aportando sus observaciones. Se trataba de una fase inicial de consultas a personas interesadas, y m\u00e1s adelante se deber\u00e1 llevar a cabo otra fase de consultas y de informaci\u00f3n al p\u00fablico general en la que cualquier ciudadano puede participar.<\/span><\/p>\n

\u00a0<\/span>Para nosotros, es determinante que el Gobierno involucre a los distintos actores involucrados en la elaboraci\u00f3n de un plan que va a marcar la pol\u00edtica energ\u00e9tica y pol\u00edtica de nuestro pa\u00eds de cara a los pr\u00f3ximos a\u00f1os. Pero no basta con abrir estos procedimientos de consulta, sino que adem\u00e1s se tiene que garantizar que las observaciones y aportaciones dadas por el p\u00fablico,<\/strong> han sido tenidas debidamente en cuenta a la hora de aprobarse la versi\u00f3n final del PNIEC, que como sabemos, Espa\u00f1a debe enviar a la CE antes del 1 de enero de 2020.<\/span><\/p>\n

\u00bfDe qu\u00e9 forma participa el Instituto Internacional de Derecho y Medioambiente en temas nacionales de car\u00e1cter ambiental como Madrid Central?<\/b><\/h4>\n<\/blockquote>\n

Nos encantar\u00eda poder trabajar en much\u00edsimos m\u00e1s temas medioambientales desde el punto de vista jur\u00eddico, ya que en Espa\u00f1a hay mucho trabajo por hacer, y tenemos potencial y expertise para abarcar muchos temas diferentes. Por desgracia, nuestros recursos son muy limitados, somos una organizaci\u00f3n peque\u00f1a que trabaja con mucha rigurosidad en cada proyecto y siempre buscamos m\u00e1s fondos para poder hacer todav\u00eda m\u00e1s actividades.\u00a0<\/span><\/p>\n

Nosotros estamos trabajando directamente en el tema de Madrid Central. De hecho, el pasado 24 de julio -justo antes de que la Comisi\u00f3n Europea demandara a Espa\u00f1a ante el Tribunal de Justicia de la Uni\u00f3n Europea por incumplir con la Directiva de Calidad del Aire- un Juez de lo Contencioso-Administrativo de Madrid ha admitido a tr\u00e1mite un recurso que hemos interpuesto desde el IIDMA contra el acuerdo de la junta de gobierno del Ayuntamiento de Madrid por vulnerar derechos fundamentales recogidos en nuestra Constituci\u00f3n.\u00a0<\/strong><\/span><\/p>\n

Son vulnerados el derecho a la integridad f\u00edsica vinculado a la salud y el derecho a la intimidad y la inviolabilidad de domicilio, ya que la mala calidad del aire afecta a dichos derechos. Se trata de un procedimiento especial de protecci\u00f3n jurisdiccional de los derechos fundamentales que es m\u00e1s r\u00e1pido que un procedimiento ordinario contencioso-administrativo.<\/strong> Ahora estamos en fase de preparaci\u00f3n de la demanda, y esperamos una resoluci\u00f3n definitiva en los pr\u00f3ximos meses. La suspensi\u00f3n cautelar del acuerdo del Ayuntamiento de Madrid que ya han adoptado otros jueces es muy positiva, pero consideramos que debemos ir m\u00e1s all\u00e1 y que el acuerdo sea declarado nulo de pleno derecho por vulnerar DDFF.<\/span><\/p>\n

En el \u00e1mbito legal del medio ambiente, muchos organismos similares al vuestro hablan de que lo m\u00e1s importante es cambiar el sistema desde el sistema. \u00bfA qu\u00e9 se refieren?<\/b><\/h4>\n<\/blockquote>\n

\u00a0<\/span>Se refieren a la importancia del Estado de Derecho y del uso de sus herramientas para lograr una mayor ambici\u00f3n en las medidas, la aplicaci\u00f3n y el respeto del derecho ambiental como parte del sistema. Y lo ideal ser\u00eda que algunas de esas herramientas se usaran lo m\u00ednimo posible, como es el caso del <\/span>litigio ambiental.\u00a0<\/b><\/p>\n

Si se respeta el derecho ambiental no es necesario acudir a los tribunales. Esto ser\u00eda una muy buena se\u00f1al y una evidencia de que estamos logrando los objetivos que marca la legislaci\u00f3n ambiental y, por tanto, del estado de nuestro planeta. Tambi\u00e9n que nuestro trabajo habr\u00eda repercutido positivamente para las generaciones no solo actuales sino tambi\u00e9n las futuras.<\/span><\/p>\n

\n

\u00a0<\/span>\u00bfQu\u00e9 entendemos por justicia clim\u00e1tica? \u00bfPorque es tan dif\u00edcil llevarla a cabo en una era donde el 95% de la comunidad cient\u00edfica asegura que lo que ha provocado esta crisis es la actividad humana?<\/b><\/h4>\n<\/blockquote>\n

Justicia clim\u00e1tica, en s\u00ed es un concepto m\u00e1s social y pol\u00edtico que jur\u00eddico. En lo que a nuestro trabajo se refiere, todas las actividades de lucha contra el cambio clim\u00e1tico que llevamos a cabo como organizaci\u00f3n tienen incidencia, pero es un concepto m\u00e1s general y no legal.<\/strong> La evidencia cient\u00edfica entorno al cambio clim\u00e1tico es muy s\u00f3lida, en efecto, y el informe del IPCC publicado en octubre de 2018 es prueba de ello: seg\u00fan este informe tenemos muy pocos a\u00f1os para contener el calentamiento global. La sociedad est\u00e1 percibiendo, cada vez m\u00e1s, que la lucha es urgente.<\/span><\/p>\n

\u00a0<\/span>Desde un punto de vista jur\u00eddico, una de las herramientas que ofrece el estado de derecho para presionar a empresas y autoridades es el<\/span> litigio clim\u00e1tico.\u00a0 Sirve principalmente <\/b>para tratar de presionar a que estos actores <\/span>adopten las medidas<\/b> que han ido posponiendo hasta ahora. Este tipo de litigios pueden versar sobre diferentes derechos, desde protecci\u00f3n de derechos fundamentales como el derecho a la vida o la salud, hasta reclamaciones por da\u00f1os y perjuicios a empresas. Aunque lo ideal a largo plazo es que no haga falta usar esta herramienta porque eso significar\u00eda que la normativa se est\u00e1 aplicando y cumpliendo.<\/span><\/p>\n

\u00a0<\/span>Desde el IIDMA trabajamos de forma muy cercana en el \u00e1mbito de acceso a la justicia medioambiental, y de hecho contamos con un proyecto a nivel europeo, financiado por el programa LIFE de la CE, que se lleva a cabo en varios pa\u00edses de la UE<\/strong> (Alemania, Austria, Eslovaquia, Espa\u00f1a, Estonia, Francia, Hungr\u00eda y Polonia). El objetivo principal es promover la correcta aplicaci\u00f3n y ejecuci\u00f3n del derecho ambiental de la Uni\u00f3n Europea a trav\u00e9s del acceso efectivo a la justicia como exige el Convenio de Aarhus. IIDMA es el coordinador del proyecto en Espa\u00f1a, llevamos trabajando en \u00e9l desde hace m\u00e1s de un a\u00f1o y en este per\u00edodo hemos organizado diversas jornadas de formaci\u00f3n para juristas y creados recursos para facilitar el conocimiento sobre el derecho para acceder a la justicia ambiental y los obst\u00e1culos que superar.<\/span><\/p>\n

\n

Hace a\u00f1os que la comunidad cient\u00edfica alerta de la necesidad de cambios inmediatos para combatir el cambio clim\u00e1tico <\/span>\u00bfPorque el poder legislativo a\u00fan no ha conseguido, por ejemplo, acabar con el carb\u00f3n?<\/b><\/h4>\n<\/blockquote>\n

\u00a0<\/span>Como se\u00f1al\u00e1bamos antes, el abandono de los combustibles f\u00f3siles y en especial del carb\u00f3n es uno de los caballos de batalla del IIDMA en los \u00faltimos a\u00f1os. Es necesario planificar un cierre ordenado para que las t\u00e9rmicas de carb\u00f3n que hay en Espa\u00f1a cierren antes del a\u00f1o 2025,<\/strong> ya que el uso de carb\u00f3n es contrario a los compromisos internacionales en la lucha contra el cambio clim\u00e1tico, y adem\u00e1s sus impactos afectan gravemente a la salud de las personas.\u00a0<\/span><\/p>\n

Un estudio presentado a principios de 2019 por IIDMA mostr\u00f3 que las emisiones del carb\u00f3n en toda Espa\u00f1a en 2016 se pueden relacionar, entre otros impactos, con <\/span>560 muertes prematuras y 340 hospitalizaciones por enfermedades cardiovasculares y respiratorias<\/b>. Adem\u00e1s, el estudio se\u00f1ala la estrecha relaci\u00f3n entre las emisiones de carb\u00f3n y sus impactos mediante el an\u00e1lisis comparativo.\u00a0<\/span><\/p>\n

Entre 2015 y 2016 se redujo en un 30% la producci\u00f3n de energ\u00eda del carb\u00f3n <\/span>que se asoci\u00f3 con una disminuci\u00f3n del 40,5% en los impactos sobre la salud asociados. <\/b>\u00a0Por tanto, el Gobierno debe buscar la f\u00f3rmula para sacar el carb\u00f3n del mix energ\u00e9tico y cerrar de forma ordenada y progresiva las centrales t\u00e9rmicas de carb\u00f3n, para no ir en sentido contrario a las pol\u00edticas de los pa\u00edses de nuestro entorno. Igual de importante es asegurarse de que el carb\u00f3n no es sustituido por otros combustibles f\u00f3siles, sino por energ\u00edas renovables.<\/span><\/p>\n

\u00a0<\/span>En la actualidad estamos trabajando en varios proyectos focalizados en cambio clim\u00e1tico y transici\u00f3n energ\u00e9tica. Comenzamos a trabajar en esta materia en 2013. Nuestro objetivo a medio plazo es que se lleve a cabo una transici\u00f3n energ\u00e9tica en Espa\u00f1a cumpliendo con la normativa vigente, y que esta normativa sea lo m\u00e1s ambiciosa posible. Nuestra prioridad es conseguir el abandono definitivo del carb\u00f3n y resto de energ\u00edas f\u00f3siles como fuentes de energ\u00eda hasta llegar a un escenario de emisiones cero.<\/span><\/p>\n

Es sorprendente c\u00f3mo en 2015 nadie hablaba de la necesidad de cerrar las centrales de carb\u00f3n en nuestro pa\u00eds. Sin embargo, gracias a nuestro trabajo hablando con algunas de las principales compa\u00f1\u00edas energ\u00e9ticas y\u00a0 con administraciones, realizando informes sobre los impactos de las emisiones de dichas centrales y litigando en los tribunales, hemos conseguido que esto se convierta en una prioridad en nuestro pa\u00eds. Y debemos reconocer que ha habido sensibilidad de parte de algunas empresas energ\u00e9ticas acometiendo nuestras recomendaciones.\u00a0<\/span><\/p>\n

De hecho, el pr\u00f3ximo a\u00f1o 2020 s<\/span>e cerrar\u00e1 la mitad de la potencia instalada de carb\u00f3n en Espa\u00f1a<\/b>, dado que muchas de las centrales de carb\u00f3n operando a d\u00eda de hoy no han acometido las inversiones necesarias para que sus centrales puedan cumplir con los l\u00edmites de emisi\u00f3n de contaminantes que marca la normativa europea.<\/span><\/p>\n

\u00a0<\/span><\/p>\n

\n

\u00bfQu\u00e9 es lo que tanto frena a los gobiernos a que realicen los cambios por cuenta propia y deba haber entidades como la vuestra presionando para conseguir cambios significativos a nivel legal?<\/b><\/h4>\n<\/blockquote>\n

\u00a0<\/span>Es un problema multifactorial, pero lo m\u00e1s importante es que haya voluntad pol\u00edtica y disposici\u00f3n para tratar el reto medioambiental y el problema del cambio clim\u00e1tico como una prioridad. Hemos mejorado respecto a a\u00f1os anteriores. La cuesti\u00f3n medioambiental va poco a poco encontrando su lugar en la agenda pol\u00edtica nacional, pero todav\u00eda falta mucho por hacer y m\u00e1s ambici\u00f3n.\u00a0<\/span><\/p>\n

\n

\u00a0<\/span>\u00bfDir\u00edas que el n\u00famero de organizaciones y entidades de derecho ambiental como la vuestra se van a disparar en los \u00faltimos a\u00f1os?<\/b><\/h4>\n<\/blockquote>\n

\u00a0<\/span>Es dif\u00edcil de decir. S\u00ed esperamos que se enfatice la importancia del derecho ambiental para la protecci\u00f3n del medio ambiente y como herramienta clave en el gran desaf\u00edo clim\u00e1tico de los pr\u00f3ximos a\u00f1os, por lo que la tendencia que esperemos que se cumpla es que se garantice un mayor cumplimiento de la legislaci\u00f3n ambiental, lo que har\u00eda innecesario que se dispare el n\u00famero de organizaciones de defensa ambiental.<\/span><\/p>\n

\n

\u00bfCrees que liderar\u00e1n las batallas legales por el clima?<\/b><\/h4>\n<\/blockquote>\n

\u00a0<\/span>Nuestra visi\u00f3n consiste en crear las condiciones legales y jur\u00eddicas para que se proteja de forma efectiva y se restauren, en la medida de lo posible, tanto el medioambiente como los recursos naturales, y esto implica hacer frente a una serie de desaf\u00edos. Para lograr esa visi\u00f3n, el principal reto se encuentra en que tanto las instituciones internacionales como nacionales, as\u00ed como la ciudadan\u00eda, sean conscientes de que las leyes y otros instrumentos normativos son unas de las herramientas m\u00e1s efectivas para responder a esos desaf\u00edos y transformar las pol\u00edticas ambientales y de desarrollo en acciones pr\u00e1cticas. Sin embargo, esto s\u00f3lo es posible cuando las leyes e instrumentos normativos se aplican de forma correcta.<\/span><\/p>\n

De hecho, <\/span>existen numerosas normas internacionales y nacionales para la protecci\u00f3n del medioambiente<\/b>, pero d<\/span>ebido a su escasa y a veces nula aplicaci\u00f3n hemos llegado actualmente a una situaci\u00f3n de crisis ecol\u00f3gica y planetaria<\/b>. Por ello, nuestra misi\u00f3n se basa en contribuir a la protecci\u00f3n del medioambiente y promover el desarrollo sostenible a trav\u00e9s del estudio, desarrollo y aplicaci\u00f3n efectiva del Derecho, haciendo hincapi\u00e9 en su Aplicaci\u00f3n, Cumplimiento y Ejecuci\u00f3n.<\/span><\/p>\n

Afortunadamente, vivimos en un estado de derecho que nos ofrece potentes herramientas para contribuir a lograr los objetivos de protecci\u00f3n de nuestro entorno y planeta. Por ello, en IIDMA, como dice nuestro lema <\/span>\u201cponemos el derecho al servicio del medioambiente\u201d, trabajamos para hacer frente a esos desaf\u00edos<\/b> que requieren la colaboraci\u00f3n de la sociedad civil, las empresas, las autoridades y todo tipo de actores, ya que son problemas que nos afectan a todos sin excepci\u00f3n. Promovemos que esta legislaci\u00f3n sea lo m\u00e1s ambiciosa posible y se aplique, cumpla y ejecute de forma efectiva y duradera.<\/span><\/p>\n
