Para <strong>Alba Iranzo<\/strong>, abogada ambiental de IIDMA, \u201ce<\/span><b>s dif\u00edcil entender<\/b><span style=\"font-weight: 400;\">, con la situaci\u00f3n actual,<\/span><b> c\u00f3mo es posible que no haya m\u00e1s fondos en Espa\u00f1a para sostener este tipo de trabajo de defensa de la legalidad ambiental\u201d.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">La entidad sin \u00e1nimo de lucro iIDMA act\u00faa como una especie de \u201cabogado del planeta\u201d y\u00a0 \u201cponen el derecho al servicio del medio ambiente\u201d reitera <strong>Alba Iranzo.<\/strong> Ahora est\u00e1n a cargo del caso de Madrid Central, aunque hist\u00f3ricamente fueron los encargados de conseguir que el \u2018cierre de las centrales de carb\u00f3n\u2019 empiece a ser una prioridad en la agenda pol\u00edtica de nuestro pa\u00eds. <\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row][et_pb_column type=\u00bb1_2&#8243; Aunque, para<strong> Iranzo<\/strong>, lo ideal ser\u00eda que algunas de esas herramientas se usaran lo m\u00ednimo posible, como es el caso del litigio ambiental. \u201cSi se respeta el derecho ambiental no es necesario acudir a los tribunales\u201d asegura la abogada.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.26.3&#8243; A\u00fan debemos conseguir la aprobaci\u00f3n de los instrumentos del Marco Estrat\u00e9gico de Energ\u00eda y Clima con los objetivos m\u00e1s ambiciosos posibles. Estos son, entre otros, <strong>establecer 2025 como fecha de fin del carb\u00f3n en Espa\u00f1a<\/strong>, y acelerar la transici\u00f3n energ\u00e9tica sustituyendo en el mix energ\u00e9tico espa\u00f1ol -los combustibles f\u00f3siles (carb\u00f3n, gas etc)-, por energ\u00edas renovables de forma ordenada y progresiva.<\/p>\n<blockquote>\n<h4><strong>\u00bfCu\u00e1les deber\u00edan ser los primeros pasos?<\/strong><\/h4>\n<\/blockquote>\n<p>Actualmente existe un <strong>borrador de Ley de Cambio Clim\u00e1tico y Transici\u00f3n Energ\u00e9tica (LCCTE)<\/strong> que debe determinar en gran medida el camino a seguir por nuestro pa\u00eds en los pr\u00f3ximos a\u00f1os. La aprobaci\u00f3n y entrada en vigor de esta Ley es una de las prioridades normativas en Espa\u00f1a en este momento ya que establece un marco estatal para la lucha contra el cambio clim\u00e1tico. Adem\u00e1s, <strong>algunas CCAA ya han aprobado o tienen en proceso de aprobaci\u00f3n, Leyes de cambio clim\u00e1tico regionales (<\/strong>Baleares, Andaluc\u00eda, Catalu\u00f1a, Pa\u00eds Vasco).<\/p>\n<p>Tambi\u00e9n es urgente la aprobaci\u00f3n de la versi\u00f3n final del primer <strong>PNIEC espa\u00f1ol que abarca el per\u00edodo 2021-2030<\/strong>. El Plan Nacional de Energ\u00eda y Clima definitivo debe ser presentado ante la Comisi\u00f3n Europea antes del 31 de diciembre de 2019 (un primer borrador de este plan ya fue enviado a la instituci\u00f3n el pasado febrero, y en junio la Comisi\u00f3n dict\u00f3 sus recomendaciones pidiendo m\u00e1s ambici\u00f3n).\u00a0<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row][et_pb_column type=\u00bb1_3&#8243; Para que las centrales de carb\u00f3n cierren antes de 2025, <strong>el Gobierno debe buscar la f\u00f3rmula para sacar el carb\u00f3n del mix energ\u00e9tico y cerrar de forma ordenada y progresiva las centrales t\u00e9rmicas de carb\u00f3n, pues estas tienen unos impactos muy significativos no solo en el medio ambiente sino tambi\u00e9n en la salud de las personas. <\/strong>Esto es esencial para no ir en sentido contrario a las pol\u00edticas de pa\u00edses de nuestro entorno como Austria, Irlanda, Italia y Reino Unido que ya han anunciado el abandono del carb\u00f3n para esa fecha, entre otros. Igual de importante es asegurarse de que el carb\u00f3n no es sustituido por otros combustibles f\u00f3siles, sino por una mayor integraci\u00f3n de las energ\u00edas renovables en el sistema el\u00e9ctrico espa\u00f1ol.<\/p>\n<p>[\/et_pb_text][et_pb_image _builder_version=\u00bb3.26.3&#8243; Adem\u00e1s, participa en reuniones y cumbres de organismos internacionales en calidad de ONG.\u00a0<\/p>\n<p>Ha tomado parte en diversas negociaciones y reuniones de las Naciones Unidas, la \u00faltima en el grupo de expertos para un Pacto Mundial para el Medio Ambiente este mismo a\u00f1o, al que ha asistido la directora del IIDMA Ana Barreira. Y lo ideal ser\u00eda que algunas de esas herramientas se usen lo m\u00ednimo posible, como es el caso del litigio ambiental. Lo ideal a largo plazo, es <strong>que no haga falta usar esta herramienta porque eso significa que la normativa se est\u00e1 aplicando y cumpliendo de manera efectiva<\/strong>. Esperamos una resoluci\u00f3n definitiva en los pr\u00f3ximos meses. La suspensi\u00f3n cautelar del acuerdo del Ayuntamiento de Madrid, que ya han adoptado otros jueces, es muy positiva. Este derecho implica el no tener que pagar la representaci\u00f3n de abogado, procurador, as\u00ed como ciertas tasas judiciales. No obstante, hasta ahora si una ONG con justicia gratuita reconocida ped\u00eda un caso ante los tribunales, en principio, no quedada exenta del pago de las costas del procedimiento, que en muchos casos, eran altamente disuasorias.<\/p>\n<p>Uno de nuestros \u00faltimas casos ante los Tribunales ha cambiado de manera significativa las condiciones de acceso a la justicia medioambiental en nuestro pa\u00eds. A ra\u00edz de un procedimiento judicial que iniciamos contra el Plan Nacional Transitorio de Grandes Instalaciones de Combusti\u00f3n &#8211; en el que se nos hab\u00eda condenado en costas tras desestimarse nuestra demanda-, el Tribunal Supremo reconoci\u00f3, sin precedentes, que las ONGs de defensa ambiental con justicia gratuita reconocida por Ley, no tienen que pagar las <strong>costas del procedimiento<\/strong> judicial cuando pierden un caso. En ese caso en particular el IIDMA qued\u00f3 exento de pagar los 11.260\u20ac de las costas a las que previamente hab\u00eda sido condenado.<\/p>\n<p>Esta decisi\u00f3n sit\u00faa a Espa\u00f1a entre uno de los pa\u00edses m\u00e1s avanzados en materia de acceso a la justicia ambiental, <strong>comparado con las barreras econ\u00f3micas a las que todav\u00eda tienen que hacer frente otras organizaciones ambientales para acudir a los tribunales en otros Estados miembro.\u00a0<\/strong><\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=\u00bb3.26.3&#8243;
